ANNOUNCEMENT OF PHASE 2 – POD EXERCISE

Sapura Energy Berhad (“Sapura Energy” or “the Group”), would like to refer to our earlier notice, which stated that the deadline for creditors to submit their proof of debt (“POD”) has been extended to 30 June 2022. With the court’s permission, we had continued to accept late submissions after this date, in consideration to our creditors.

For the purpose of voting at the court-convened meeting pursuant to the subsisting court order, Sapura Energy must bring closure to the POD exercise.  Accordingly,  the Group has set 20 October 2022 as the final cut-off date for the proof of debt (POD) submissions. We regret to inform you that the scheme companies cannot entertain any POD submissions after the 20 October 2022 cut off. In this regard, the scheme companies will rely on the companies’ records to determine the value of claims for the purpose of voting at the court-convened meeting. 

Kindly be informed that the POD verification and notifications in response to the claim submissions are ongoing concurrently . The Group would like to thank all vendors for their patience and cooperation throughout this period. 

We would like to provide you the latest updates regarding the next phase of our scheme of arrangement (SOA) process; namely the commencement of the Proof of Debt (POD) exercise along with guidelines to submit your POD claims.

The commencement of Phase 2 of the SOA began on Friday, April 21, 2022. Please submit the prescribed form below, to facilitate the POD exercise and help us verify the outstanding amount due to you by the 23 subsidiaries listed here.

Your participation in the POD exercise is crucial to ensure all outstanding payments are captured and verified, for the purpose of voting in the proposed SOA.

Please ensure your submission is accurate and complete with information and/or documents to substantiate your POD claims.

Your claim(s) shall be in respect of goods and/or services rendered, and other claims against the 23 subsidiaries, on or before 31 January 2022, including contingent claims and other liabilities.

Please note that should you fail to submit your POD claims, the value of your claims will be determined based on our subsidiaries’ records for the purpose of voting at the Court-convened meeting.

Please strictly adhere to the POD exercise timeline below, to ensure we are on track for Phase 3 of the SOA process:

It is very important that you submit your POD latest by 5.30 pm, Friday, May 20, 2022. Regretfully, any late submission of POD after the deadline will not be accepted, subject to the discretion of the schemed companies when required.

The POD must be submitted via an online form using the Microsoft Form (MS Form), using the unique login credentials sent.
